Doing Business As (DBA)

Requirements

IMPORTANT: Businesses filing in Branch County are required to use forms provided by this office.

A Certificate of Assumed Name or a Certificate of Co-partnership must be filed in every county where a business is owned or conducts business.

It is your responsibility to check locally and with the Department of Labor & Economic Growth Services to ensure there are no existing business using the name you have chosen. (Telephone numbers for DCIS are listed below).

This office reserves the right to receive documents, but delay filing, until all statutory requirements are met.

It is your responsibility to notify this office and file the required forms if you:

  1. Change the principal business address
  2. Add or delete persons
  3. Dissolve the business (business is closed of filed at state level).

The following entities DO NOT file at the County level. They should file at STATE LEVEL:

  • Corporations
  • Limited Partnerships (LLP’s)
  • Limited Liability Companies (LLC’s)
  • Assumed Names Owned By Corporations
  • Nonprofit Organizations Owned By Corporations

The Certificate of Assumed Name and Certificate of Co-partnership are legal documents. All information given on them must be complete and accurate.

Signatures MUST be signed and witnessed by a Notary of Public. This office will provide notarization if all owners are present at time of signing, and have a current valid Driver’s License or State Issued ID.

At the time of filing, this office will verify if the business name chosen is available. Once accepted, certified copies of that business name will be issued. Your DBA will expire 5 years from date of filing.

Costs

$16.00 for a NEW filing of the Certificate of Assumed Name or Co-partnership.  Two (2) certified copies will be provided.

$14.00 for Renewing the Certificate of Assumed Name or Co-partnership.  Two (2) certified copies will be provided.

$10.00 for Dissolution; Change of address of Business; Change of Ownership.

$2.00 for certified copy of a Business Registration currently on file.
